Shelter In Place -UPDATE

The Governor issued his proclamation which ordered residents to “shelter in place” and suspended all but essential travel. This is effective Saturday March 21, 2020 at 5:00 p.m. through April 7, 2020 (For Now).

We have not read the actual text of the Order, and articles outlining what is or is not allowed is far from comprehensive. We still have no reason to believe this Order interferes with your Court Ordered Obligation to exchange your child or children pursuant to an existing schedule. Until we learn otherwise, our advice on this issue remains the same. You must comply with your Court Ordered obligations as it existed before the issuance of this Order.

For those of you beginning to exercise expanded time for Spring Break, your obligations still remain the same. Review your court order and follow the instructions. If you are planning on traveling out of the state for Spring Break, please contact us before making such a commitment. We do not believe it should happen.

We hope this update addresses any concerns you have on this subject. Further the law and rules are always changing in this regard. If this does not address your concerns, please do not hesitate to call our office at 309-829-9400 or email us. We will get back to you as soon as possible.

Thank you for your cooperation and patience during this time.

additional update: I have read some text of the order. It allows transportation for following the direction of law enforcement or court order, including to transport children pursuant to a custody agreement

Further I have reason to believe our local Judges will Hold those using this situation to stop on-duty parenting time in contempt of court,

Shelter In Place

To all of our Brucker Law clients.

Word is circulating that a “shelter-in-place” order is being issued effective at Noon on Saturday March 22, 2020. At this point, and based upon what we are hearing, this does not impact your on-duty parenting arrangements pursuant to a Court Order.

Things may change and when they do, please check back in with us. If this announcement does not address your concern, please call us at 309-829-9400 or email our office. We will get back to you as soon as possible. Thank you for your patience.

Have a good safe weekend.
